API License Agreement

This API license agreement (hereinafter referred to as the "Agreement") defines the rules for the User's (hereinafter referred to as the "Licensee") access to API, data and documentation provided and licensed by the Garantex Service. By using the Garantex API, the User must comply with the terms of the Agreement. Otherwise, the User cannot use the API.

1. General Provisions

1.1. An "Application programming interface" or "API" is a collection of libraries, tools, source code samples, published specifications and documentation developed by the Garantex Service. The Garantex service also, at its discretion, may provide the Licensee with updates or additions to the API.

1.2. The documentation includes (but is not limited to): a programmer's guide, materials and information required to use the API.


 

2. License Grant

Under the terms of this Agreement, Garantex grants the Licensee a limited, non-exclusive, non-transferable license (without the right to sublicense) to use the API solely for the personal use of the Licensee (developing applications for working with Garantex products). The Licensee has no right to distribute, license or otherwise transfer the API to third parties.


 

3. Other rights and restrictions

3.1. Licensee may copy the API only for use under this Agreement.

3.2. Reverse engineering. Licensee has no right to the API source code, except for the rights expressly granted to Licensee by this Agreement. Licensee may not reverse engineer, decompile, modify or disassemble the API, or otherwise reduce the API to a generally accepted form of representation in whole or in part, except as expressly permitted by this Agreement or applicable law.

3.3. To use the API effectively, you may need development tools, a compiler, and other additional software ("Third Party Software"). Licensee is solely responsible for acquiring this software and the required licenses. Garantex assumes no obligation or warranty for the Licensee's use of the Third-Party Software.


 

4. Property

The Garantex Service retains proprietary rights, including all rights to patents, copyrights, trade secrets, trademarks and other intellectual property rights, to the API and any changes to them. Garantex has the exclusive right to register any patents and copyrights. The Licensee acknowledges that, in accordance with this Agreement, he has no ownership of the API, only the right of limited use in accordance with the terms of this Agreement.


 

5. Support

The Garantex service does not provide technical support for the API in accordance with this Agreement, does not provide updates, bug fixes or changes to the API when contacting support.


 

6. Confidentiality

6.1. APIs contain valuable information and trade secrets of the Garantex Service, which remain the property of Garantex. Licensee must avoid disclosure of this information and unauthorized use of the API.

6.2. Licensee must not disclose, advertise or publish the terms of this Agreement without the prior written consent of Garantex. Any press release or publication related to this Agreement is subject to prior review and written approval by Garantex.


 

7. Guarantees

API and documentation are provided without warranty of any kind. Garantex does not guarantee that the API and documentation are suitable for use by the Licensee, free from defects or errors. In addition, Garantex does not guarantee constant uninterrupted access to API and documentation and does not give any guarantees regarding the results of their use.


 

8. Limitation of Liability

The licensee is solely responsible for any damage to its computer system or loss of data resulting from downloading or using the API. Garantex is not responsible for any special, incidental, consequential damages (including but not limited to loss of profits, suspension or termination of work, failure or breakdown of a computer, loss of information or any other damages, including monetary, arising from the use of or inability to use the API or provide or fail to provide support services), even if Garantex has been advised of the possibility of such damage.


 

9. Compensation

The Licensee releases the Garantex Service, its customers, suppliers or other partners and employees from liability for any loss, claim or claim, reasonable legal costs arising from its use of the API.


 

10. Terms and termination of the Agreement

10.1. If the Licensee does not comply with any of the terms of this Agreement, then he is liable to Garantex for damage or loss caused by the violation of the terms.

10.2. Upon termination of this Agreement, Licensee must immediately cease using the API, destroy all copies of the API and documentation, or return them to Garantex.

10.3. Garantex has the right to verify that the Licensee has complied with the terms of this Agreement. The licensee, at the request of Garantex, is obliged to facilitate this.


 

11. Other provisions

11.1. Violation or non-compliance with the terms of this Agreement will result in its termination.

11.2. Garantex has the right, at its sole discretion and without warning, without giving any reason, to suspend (or terminate) the Licensee's access to the Service in case of violation of the terms of this Agreement.

By installing, copying or otherwise using the Garantex API, the Licensee confirms that he has read, understood and agrees to the terms stated above.
